1. Acceptance and scope
By accessing the ModelRush site, creating an account, or using the dashboard, APIs, SDKs, intelligent routing, or related services, you agree to these Terms and the policies they reference. If you use the service for an organization, you represent that you can bind that organization. Do not use the service if you do not agree.2. Services and third-party models
ModelRush provides a unified interface for discovering, invoking, routing, and observing text, image, video, audio, and other AI models operated by ModelRush or third-party providers. Models, routes, limits, pricing, regional availability, and features may change.Third-party models may remain subject to their providers' usage policies, licenses, and technical restrictions. ModelRush does not control their training data, continued availability, or output quality.3. Accounts, eligibility, and security
You must provide accurate account information and have legal capacity to enter a contract. Spicy models are available only to users who have truthfully confirmed they are at least 18; ModelRush may block or revoke restricted access when that attestation is missing or unreliable. You are responsible for activity under your account and for protecting passwords, sessions, API keys, and other credentials. Revoke affected keys and notify ModelRush promptly if you suspect unauthorized access.โข Never expose production keys publiclyโข Use least privilege across environments and team membersโข Do not bypass rate limits, access controls, or security measures
4. Inputs, outputs, and licenses
As between you and ModelRush, you retain rights you hold in prompts, files, images, video, audio, and other inputs. You grant ModelRush the limited rights needed to process that content to provide, secure, troubleshoot, and improve the services you select.To the extent permitted by law and third-party terms, you may use outputs generated for you. AI outputs can be inaccurate, non-unique, similar to others' outputs, or contain material you cannot lawfully use. You must review outputs before publication, commercial use, or important decisions.5. Images, video, and likenesses
Upload and generate only material you have the right to use. Face and head swap may use only your own portrait or images for which every identifiable person has explicitly authorized that use. Unauthorized profile photos, avatars, and likenesses are prohibited. When identifiable people are involved, obtain appropriate consent and follow privacy, publicity, intellectual-property, advertising-disclosure, and local synthetic-media rules.โข No non-consensual intimate imagery or sexual content involving minorsโข No fraudulent impersonation, harassment, extortion, or harmful deceptionโข Do not falsely attest to age, portrait rights, or per-request consentโข Do not remove provenance markers or evade required synthetic-media disclosuresโข Do not commercially exploit another party's brands, works, or characters without authorization
6. Acceptable use
You may not use the service for unlawful, harmful, deceptive, or rights-infringing activity, or help others do so. We may investigate abuse and restrict, suspend, or terminate access where reasonably necessary.โข Malware, credential theft, cyberattacks, or evasion of safeguardsโข Hate, harassment, violent threats, trafficking, or other serious harmโข Unauthorized surveillance, sensitive-trait inference, or identificationโข Spam, fake engagement, election manipulation, or fraud at scaleโข Violations of provider policies, export controls, sanctions, or applicable law
7. Fees, credits, and taxes
Applicable pricing, usage units, platform fees, prepaid credits, subscription periods, and taxes are governed by the order, dashboard, or written agreement shown at purchase. Subscriptions renew for the selected period unless canceled before the renewal date; after cancellation, access continues through the current paid period. Unless mandatory law or an order says otherwise, incurred model usage, delivered platform services, and consumed credits are non-refundable. Unused credits expire as disclosed at purchase, and you are responsible for applicable taxes.8. Intellectual property and feedback
ModelRush and its licensors retain rights in the platform, software, brands, documentation, and underlying technology. These Terms grant only a limited, revocable, non-transferable license needed to use the service. You may provide feedback voluntarily, and ModelRush may use it to improve the product without identifying you.9. Changes, suspension, and termination
We may change or discontinue parts of the service for security, legal, provider, maintenance, or product reasons. We may restrict or suspend an account for security risk, nonpayment, material breach, or likely harm to the platform or others. After termination, stop using the service and follow the then-current export and deletion process for account content.10. Disclaimers and limitation of liability
To the fullest extent permitted by law, the service is provided โas isโ and โas available,โ without warranties that outputs are accurate, unique, non-infringing, uninterrupted, or fit for a particular purpose. Generative AI is probabilistic, and you remain responsible for model selection, output review, and deployment decisions.To the fullest extent permitted by law, ModelRush is not liable for indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, data, or goodwill. ModelRush's aggregate liability arising from or related to the service is limited to the greater of the amount you paid ModelRush during the 12 months before the event giving rise to the claim or US$100. This limit does not apply to liability that applicable law does not permit us to exclude or limit.If you use the service for a business or organization, you agree to defend, indemnify, and hold harmless ModelRush and its affiliates from third-party claims arising from your Customer Content, unlawful use, infringement of third-party rights, or violation of these Terms.11. Governing law, disputes, and updates
If an order, invoice, or written agreement identifies the ModelRush operating entity, governing law, or dispute venue, that document controls. Otherwise, these Terms are governed by the laws of the location of the ModelRush entity responsible for your account relationship, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes informally through legal@modelrush.ai for 30 days; unresolved disputes will be handled by courts of competent jurisdiction at that entity's principal place of business. Consumers retain non-waivable rights under applicable law. Material updates will be posted on the site, in the dashboard, or through account notices with an effective date.Legal and privacy questions
